WAIVER OF CLAIMS, RELEASE OF LIABILITY, ASSUMPTION OF RISKS

AND INDEMNITY AGREEMENT

WAIVER OF CLAIMS AND RELEASE OF LIABILITY

By signing below, I hereby irrevocably WAIVE, RELEASE AND FOREVER DISCHARGE Silver Bell Coaching LLC  ( “SBC”), its members, directors, officers, employees, agents, independent contractors and insurers from any and all liability, claims, demands or causes of action (collectively, “Claims”), including but not limited to Claims for personal injury, accidents or illnesses (including death), property damage, medical expenses and loss of services sustained by any person that in any way relate to or arise from my engagement with or participation in SBC services or at an SBC event.

ASSUMPTION OF RISKS AND INDEMNITY

In consideration of my voluntary participation with SBC, I acknowledge and agree:

• TO ASSUME AND ACCEPT ALL RISKS (including but not limited to physical injury and death) arising out of associate with or related to my participating in the SBC Services.

• TO BE SOLELY RESPONSIBLE FOR ANY INJURY, LOSS OR DAMAGE which I might sustain while participating in SBC Services.

• TO HOLD HARMLESS AND INDEMNIFY SBC from any and all Claims by any third party resulting from my participation in SBC Services.

SEVERABILITY: The foregoing waiver, release, assumption of risk and indemnity is intended to be as broad and inclusive as is permitted by the law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

ACKNOWLEDGEMENT

I have carefully read this Waiver of Claims, Release of Liability, Assumption of Risks and Indemnity Agreement and fully understand its contents, and I fully understand that I have given up substantial rights by signing it and am aware of its legal consequences.  I acknowledge that I have executed this agreement voluntarily and that this agreement is binding to myself, my heirs, executors, administrators and representatives in the event of my death or incapacity.
